El quinto informe de ObservaJEP presenta un análisis de los asuntos priorizados por ObservaJEP en 2023. Este informe muestra los retos que tiene la JEP frente a la aplicación de fuentes del derecho internacional en materia de la competencia personal de la jurisdicción, las armas prohibidas y la aplicación de enfoques diferenciales. A su vez, se muestran los desafíos que aún tiene la JEP en materia de reparación, la formulación de proyectos de sanciones propias y la noción del territorio como víctima.

El informe muestra los principales avances y retos que dejó el 2022 para la JEP. En especial, se hace referencia a decisiones en materia de competencia personal, mecanismos de reparación, selección negativa, el papel de la audiencia única de verdad y la calificación jurídica de las conductas. Se enfatizo en los resultados de las primeras tres resoluciones de conclusiones de la SRVR.

The report highlights the first Determination of Facts and Conduct Rulings within macro-cases 001 and 003 and develops concepts related to the paradigm of restorative justice within the SJP, the proper sanctions and the work, activities and actions with reparative content.

The report identifies important challenges regarding the application of the principle of legality and the principle of favorability in the SJP. It furthermore provides an analysis of judicial decisions that develop concepts such as the reclassification of criminal conduct and the right to truth in the SJP.

The report presents a technical and legal analysis of important judicial decisions of the SJP on the guarantee of non-extradition, the functioning of the conditionality regime and the scope of the SJP's personal jurisdiction in relation to the phenomenon of paramilitarism, among others.
